Ladies and Gentlemen,
Honourable Audience,

Let me express my sincere gratitude to the Royal Institute of International Affairs for this opportunity to deliver a speech.

Today the term of Europe is perceived not only in a geographical, historical, or cultural sense, but also as a synonym of dynamic and large-scale political and economic fusion, thus making the phenomenon of European integration a reality. Alongside economic and political reasons, moral imperative valences have complemented the process of geographical enlargement of the European Union with that of reunification, where old European nations can meet again.

Moldova has always been and still is a European country with the same values and aspirations, which crystallized in the end to make the European integration objective of the country a priority and irreversible. That was probably meant to be, because this option survived almost 10 years of turmoil in the ruling parties. Up to a recent time, the European integration of Moldova was not only the most mediated subject, but the most controversial too, because political forces that called themselves European were unable to make up their minds on this objective and the means to achieve it. Although the majority of the people are in favour of the European choice, the ruling parties, in their hesitation, were unable to transpose this choice into a programme document that would have set and prioritised the tasks based on a realistic, systemic and consistent approach.

Things began to change in the last 2 years, when the premises for a new quality political configuration appeared. Although in early last year, in the eve of parliamentary elections, there was a fear of emerging political instability, on March 6th the country's political forces demonstrated their commitment to the values of a pluralist democracy and the rule of law. Thus, the pro-European choice has become an axiom for domestic politics, a direction-setting factor for the new political elite of Moldova. After talks following the election day, the majority and the opposition established a constructive dialogue, which resulted in an unprecedented political consensus on the imperatives of Moldova's national interests - the European integration and Transnistrian conflict settlement.

The best proof that the forces represented in the current legislative body have the political maturity, the intelligence and the flexibility needed for promoting the interests of the whole country is the unanimous vote in March of 2005 of the first document, namely the Declaration on the Political Partnership to Achieve the Objective of European Integration of the Republic of Moldova. In this document the Moldovan parliamentarians, while being political opponents with different opinions on methods, steps and timing to reform the economic and social system of Moldova and acknowledging the existence of some differences on issues of domestic and foreign policy, decide to join their efforts to achieve these priority objectives.

In this context, the Declaration notes that the fulfilment of these tasks is possible only through responsible cooperation between the government and opposition, stability of domestic politics, free operation of mass media and strengthening of Moldova's independence. Thus, the Parliament has set the following priorities:

  • Observance of democratic standards and the rule of law as basic preconditions for any political and institutional reform; establishing an independent judiciary that complies with the European Union's standards and norms;
  • Establishing a relevant framework and mechanism to streamline the harmonisation of the national legislation with the principles of the Acquis Communautaire;
  • Boosting social and economic development, strengthening administrative capacities, ensuring a functional socially-oriented market economy with a favourable investment climate, fighting corruption, etc.;
  • Finding a peaceful and final resolution of the Transnistrian problem on the basis of the country's Constitution and international law standards.

Ladies and Gentlemen,

I would like to draw your attention to the wording of these priorities as they are virtually similar to the Copenhagen criteria - stability of democratic institutions that guarantees democracy, rule of law and human rights; ability to face the pressures of Common Market forces; ability to make commitments as an EU member state. In this context, I would like to briefly refer to the outcome of the parliamentary year 2005, from which the tasks to be fulfilled this year result.

One of our Parliament's basic tasks is bringing the national legislation in line with the Acquis Communautaire, and I am confident that this concept will soon become a guideline for all participants and at all stages of the legislative process in Moldova. As a supporter of a systemic approach, I initiated, as a first stage of this process, the drafting of a legislative Programme for 2005 - 2009. Having in mind our priorities, on the one hand, and the limited resources, on the other hand, this Programme sets the necessary premises for optimising the relation between two components of the legislative process - drafting new laws and, at the same time, a gradual review of the current legislation, with the view of bringing the Moldovan legal framework in line with the Acquis Communautaire. Furthermore, a formalisation of the process of harmonisation should be supplemented with an institutional component. In this respect, we rely on the willingness of our colleagues from the countries recently acceded to the EU to share their experience gained during accession. I would like to note the progress achieved through the contacts we have established, which have been developing very successfully.

I believe it is in this way that we will advance to meeting the Copenhagen criterion concerning the ability of a country to meet the EU membership commitments. At the same time, the legal prerequisites are being established to meet the criterion regarding the capability of a country to meet the Common Market pressures.

I would like to mention that the Council of Europe's requirements on the democracy and rule of law, human rights and basic freedoms are practically identical to those of another Copenhagen criterion. Obviously, Moldova as a member of the Council of Europe committed itself to honour those commitments. In this context, we have assumed the task to ensure the implementation in 2006 of the remaining commitments to determine the Parliamentary Assembly of the Council of Europe to decide upon ending the monitoring period for Moldova, and moving to the next level of cooperation - to a post-monitoring stage.

As a first step, Parliament has set up several working groups that include representatives of all the parliamentary factions, which drafted a set of proposals to amend the Moldovan law in accordance with the Council of Europe recommendations. I will mention the most important ones:

  1. The amendment to the Electoral Code improves the ballot standards. Moreover, for the first time, the political independence of the Central Electoral Commission has become reality, with most of its members - 5 out of 9 - being appointed by the opposition.
  2. The independence of judiciary is enhanced by providing, for the first time, that the General Assembly of Judges is the body that ensures the self-administration of the judiciary, and, at the same time, has the exclusive power to elect 7 of a total of 9 members to the High Council of Magistrates. Other two members are elected by Parliament, one proposed by the parliamentary majority and the other - by opposition.
  3. The amendment to the Audit Court Act balances the political aspect of its activity as, again, for the first time, a majority of its members - 4 out of 7 - is appointed by the opposition.

As a second stage, we drafted a Schedule of legislative actions, passed by Parliament in November of 2005. Under the political consensus I referred to above, we managed to finalise two documents that had previously caused disagreement, and which are namely the Drafts Law on Religions and their Components and on the Audiovisual. We will focus further on drafting legislation that will develop and strengthen local public autonomy. The improvement of legislation concerning the National Institute of Justice, the status of judges, law enforcement bodies and bailiffs, the Disciplinary Board and disciplinary liability of judges, the Judges Qualification and Attestation Board, attorney office and the bar will also contribute to the judiciary reform.

I would like to note that this Schedule is an instrument both for coordination of Council of Europe expertise, and for self-monitoring and self-discipline. I strongly believe that the Moldovan Parliament is already at a level of political maturity when the position of a "diligent student" is substituted with that of a reliable partner, an equal side in the dialogue.

Ladies and Gentlemen,

The democratic values and principles place the civil society among the basic elements of the rule of law. I would like to express my deep conviction that public authorities as well as representatives of civil society are prepared already to acknowledge that only effective cooperation in the implementation of announced goals gives them a truly national focus.

In this context, we proposed to the non-governmental organisations a Concept of cooperation of the Parliament with civil society. This document focuses on an open and permanent dialogue aimed at improving decision-making and streamlining the non-governmental sector development, a task to be fulfilled by a mechanism of consultation and cooperation. The first testing of this mechanism led to the adoption of the Concept in Parliament, and the upcoming parliamentary session will give us the first experience of collaboration in that regard. However, I would like to emphasise that this is just one of the component elements of the opening of the Moldovan Parliament to the public, an aspect to which our European partners drew our attention repeatedly in the context of political reforms and strengthening of a democratic society.

Honourable Audience,

We must acknowledge that the future of Moldova is inseparable from the resolution of the Transnistrian conflict through a territorial, political, economic and social reintegration of the country based on the Constitution of Moldova and international law standards, in close cooperation with the European Union, USA, Russia, Ukraine, Romania and the OSCE.

In this regard, the Parliament's contribution consists, first of all, in providing a legal framework for final settlement of the dispute and for making the region a component part of an integral, pluralist democratic state governed by law. To this end, during the year 2005 the Parliament passed a number of legal acts that are in line with the new realities, which put in words, for the first time in the history of Moldova's independence, a set of legal standards expressing a clear and firm position vis-?-vis the principles and mechanism of Transnistrian dispute settlement.

I refer here to the Declaration of the Moldovan Parliament that welcomed the Ukrainian initiative for Transnistrian settlement, and to the Appeals on the criteria for the democratisation of the Transnistrian region and on the principles and conclusions for the demilitarisation of the Transnistrian region, which emphasise:

(i) the need to hold free and democratic elections under the Constitution of the Republic of Moldova, according to international democratic standards and in a context of political pluralism and freedom of expression; and

(ii) the fact that this process needs:

  • liquidation of the political police (Ministry of State Security);
  • reform of the region's judiciary;
  • removing obstacles for free operation of Moldovan political parties in the Transnistrian region;
  • removing obstacles for free operation of national and local mass media, and civil society organizations in the Transnistrian region.

It is obvious that these actions cannot be carried out in a situation when the Transnistrian region is militarised to the extreme and has a system in place to suppress democratic values. In this context, the Moldovan Parliament calls upon the OSCE, the European Union, the Council of Europe, the United States of America, the Russian Federation, Ukraine and Romania to contribute by concerted efforts to the removal of such threats of the military factor through the demilitarisation of the region. For its part, Moldova commits to proposing and ensuring, through an International Mission of Military and Civil Observation, the dismantling of military formations in the region, the withdrawal of weapons and munitions, as well as the social rehabilitation and retraining of personnel in so-called Transnistrian military units.

On July of 2005 Parliament passed the Law on Basic Provisions of the Special Legal Status of Localities from the Left Bank of Dniester (Transnistria) as an inalienable part of Moldova. It is for the first time that the Moldovan legislative body voted for granting to the region a widest autonomy within the Constitution, rejecting as unacceptable any reintegration but by peaceful means, and calling for a political, socio-economic and humanitarian support to the region's residents.

Under the Low, upon the fulfilment of conditions regarding the demilitarisation and democratisation of the Transnistrian region, talks will be conducted to jointly draft a Transnistria Special Legal Status Act. This will be one of the last major stages in the legal settlement of the dispute. I would like to express herewith my total disagreement with the proposal of the OSCE presidency-in-office concerning the idea of federalisation of Moldova as the only way out to settle the Transnistrian conflict.

At the same time, I highly appreciate the active engagement of the European Union in the Transnistrian conflict settlement through:

  • appointing a Special Representative for Moldova, Ambassador Jacobovits, in March of 2005;
  • establishing a European Commission Delegation in Chisinau that will contribute to the development of the whole range of our cooperation relations;
  • expanding the negotiation format for the Transnistrian conflict settlement, to include two important actors, which are the EU and US. I hope that in near future the EU and US status of observers will be replaced with the status of full-flagged participants;
  • launching the EU Monitoring Mission of the Moldovan-Ukrainian Border on 1 December 2005.

Ladies and Gentlemen,

Since 1990, the European Communities have been confronted with the problem of defining their relations with the countries of the former USSR. Although Moldova, just as the Baltic states, comes from the post-Soviet space, the further destinies of these countries have proven different. The current legal framework for Moldova's relations with the community was set by the Partnership and Cooperation Agreement, signed in 1994 and enforced on July of 1998 for an initial period of 10 years.

At the same time, with reference to the prospects of the Moldovan - European relations, I need to mention two notable features of that agreement. Firstly, it's the disproportion on commitments of the parties. Secondly, the vague and rather general provisions of the agreement that depict a limited number of concrete, consistent actions, of which very few are provided with time references. After having been directly involved in the implementation of the agreement for several years, in conversations with many colleagues from the European Commission I came to the conclusion that we might never be able to say that we have fully implemented the PCA. And that was precisely the condition reiterated on several occasions by EU officials in reply to Moldovan authorities' solicitations to accept our aspirations for eligibility for candidate status.

The process of enlargement of the European Union has lead to the need to revise its relations with neighbour countries. In conclusion, in March of 2003, the European Commission has issued a Communication on Wider Europe Neighbourhood - a proposed framework for relations with EU neighbours in the East and South offering perspectives in several domains. The Communication also notes the opportunity of establishing a new legal arrangement, conventionally named "Neighbourhood Agreement".

The Moldova-EU Action Plan, signed in February of 2005, derived from these two European documents. In my view, the Action Plan, although a political document, does not go beyond the vague and general PCA provisions regarding the political prospects of the country. Bearing in mind the two particularities of the agreement, had a plan like this one, even less ambitious, be drafted in the first years of the PCA implementation, relations between us would have been more advanced, and Moldova would have registered a better socio-economic and political performance.

Nevertheless, encouraged by the "EU acknowledgement of Moldova's European aspirations", the political leadership and the civil society have voiced their irreversible stance in favour of European integration. I would like to note here that this vector was selected with a clear understanding of the difference between "integration" and "accession", which are often confused. Moldova perceives its European integration first of all as a domestic task of modernising its state structure. This is not a "cover up" statement for the event that Moldova's EU membership prospects are postponed until further notice. The Moldovan authorities chose not to passively wait for the future to come, but have adopted an active and pragmatic stance to make good use of every opportunity of integration. Political, legislative and socio-economic reforms conducted today are in essence European, and are based on taking over, adapting to the local realities and applying to the national systems of European legislative quanta and socio-economic models.

Along those lines, the Action Plan currently represents a "roadmap", the successful implementation of which will pave the way to a new format of relations with the European Community. I would like to come back to the Commission's Communication of March of 2003, which notes that an individual assessment of the Action Plan implementation will determine the contents of a future neighbourhood arrangement. Although that has not been specifically reflected in the Action Plan, such a note would give significant momentum to Moldova to streamline its political and economic reforms, which would actually mean a progressive adherence to the Copenhagen criteria.

I am confident that, in spite of its enlargement concerns, the European Union will not delay a revision of its relations with the neighbour countries. After Romania accedes to the Union, the new EU border should not become a new delimitation line for Moldova, as the new context will place us in a very sensitive situation. A well-defined rapprochement policy that will develop the existing legal framework and will base on common values, will allow us to act in mutual benefit.

I am stating facts, because the setting of a new perimeter of the European border coincides in time with the terms set for the implementation of the EU-Moldova Action Plan. Among the specific problems that will occur by that time, I can mention the establishment of a visa regime between Moldova and Romania - an EU member state by then, and the cancellation of the Moldovan-Romanian and Moldovan-Bulgarian Free Trade Agreements. These two issues alone will cause, among others, numerous social and even psychological problems.

Obviously, I am far from the calling here and now for a political decision to grant candidate status to Moldova. Nevertheless, I believe the time is appropriate to discuss with our European colleagues three issues that have become imperative, and which are:

  1. the contents of a new contractual arrangement, other than the Partnership and Cooperation Agreement, which is superseded both in form and content;
  2. the contents and format of European assistance instruments to replace the current TACIS program, which does not meet the new realities;
  3. starting procedures of granting Moldova Autonomous Trade Preferences, which, given the little export capacities of Moldova, could not prejudice enormous Common Market.

Moreover, I am confident that the European Union will benefit along with Moldova from these measures. Moldova will benefit not only by boosting its socio-economic and political development, but also by consolidating its statehood, thus opening new dimensions for the resolution of the Transnistrian conflict. And this fact fully corresponds to the Union's declared goal of having prosperous and politically stable neighbours.

That is how I see our short-term bilateral priorities. And I base my judgment on the reasons described above when I bid, in the mid-term prospect, for Moldova's accession to the European Union as a full-fledged member - this is the only logical option there is, in every aspect - moral, political, economic, social and cultural.
